“The Demurrage Industry must change” is a refrain we are constantly hearing from tanker owners. This is largely because the 90 Day time bar period is regularly used as a period of 3 months “free” credit for charterers and traders or as an excuse not to respond or look at a demurrage claim until 90 days has expired. On the other hand, given the amount of documentation and the corresponding complexity of modern demurrage claims analysis, charterers and traders who are responsible for paying need time to review, negotiate and process the payment – when is demurrage due and how long time should be allowed to analyse a claim?

This one-day forum is focused on providing an important opportunity for tanker owners and anyone responsible for demurrage claims or the operation or negotiation of tanker charterparty contracts to review the latest the latest developments in the law relating to operations and the recovery of demurrage, common demurrage dilemmas – demurrage rates and hotel bunkers, common misconceptions over interim port clauses and the ongoing debate over time bar clauses.

Guaranteed to provoke discussion and improve practical understanding, a panel of industry experts will share their knowledge and experience. Asdem events involve active audience participation so this event will include a workshop with practical case studies covering the contentious issues which are likely to arise.

THE MODERN DEMURRAGE CLAIMS ENVIRONMENT

Optimising the form and terms of the modern oil and gas tanker voyage charterparties in use. How to deal with the frustration of recovering demurrage claims from difficult charterers and effective commercial strategies available to deal with such counterparties.

  1. Strategies and charterparty terms that owners can use to eliminate delaying tactics: How to deal with charterers who repeatedly fail to acknowledge receipt of or respond to a claim until several months have elapsed.
  2. Tools for dealing quickly and effectively with charterers who take unsustainable positions: Even when a claim is acknowledged discussion is often deliberately protracted and drawn out with counterparties asserting legally unsustainable positions. This leads to entrenched stalemates and inevitable requests for unjustified discounts for a quick settlement.
  3. Firm but amicable approaches for dealing with claims that are agreed or undisputed but payment is nevertheless delayed for considerable periods with the potential breakdown in commercial relationships.

The fee for this one-day conference, which will be held at the Hotel Athenaeum Intercontinental, Athens, Greece is US $850 (plus VAT at 20% for companies based in the UK). This fee includes event documentation, refreshments, lunch (please inform us if you have any special dietary requirements) and an evening cocktail reception and networking event for the Laytime and Demurrage community.
